Oneida Nation submits arguments to 2nd Circuit in foreclosure case

The Oneida Nation submitted a brief to the 2nd Circuit Court of Appeals in its foreclosure case.

The tribe has waived its sovereign immunity in foreclosure proceedings. But the tribe says land within its ancestral reservation still can't be taxed by Oneida County and Madison County.

The tribe cites a similar case involving the Cayuga Nation in which two counties were blocked from asserting authority on Cayuga land even though the land was not held in trust. The U.S. Supreme Court declined to hear that case, which originated in the state court system.

The Supreme Court was due to hear the Madison County v. Oneida Indian Nation until it was notified that the Oneida Nation waived its sovereign immunity.
