John Graham to be sentenced for role in Aquash murder in 1975

John Graham will be sentenced in South Dakota today for his role in the 1975 murder of American Indian Movement activist Anna Mae Pictou Aquash.

Graham was convicted of felony murder committed during the kidnapping of Aquash in December 1975. He faces a mandatory life sentence but he plans to appeal the verdict.

Graham, a Native man from Canada, was tried in state court for crimes that occurred in Rapid City, off the reservation. He was not tried in federal court because he is not considered an "Indian" under U.S. law.
